ACCEPTANCE OF TERMS OF USE OF WEBSITE

Welcome to www.KingdomOfWinter.com (“Site”). These are our Terms of Use which you should read before you use the Site. These terms are a legally binding agreement between KINGDOM OF WINTER LTD and you. They will govern the relationship between you and us and everything that you do on the Site. If you do not wish to be bound by these Terms of Use, please do not use the Site. We may change our Terms of Use from time to time without notification and you should regularly review these terms when you visit our site.

These Terms of Use govern your use of the Site, the information that we make available to you on the Site and any goods or services that we sell you directly from this Site. These Terms of Use do not govern any other relationship with any third party. If you are entering into a contract with a third party we will make this clear to you on the Site and you ought to read the third party’s terms and conditions carefully before entering into a contract with them. By using this site, you accept that you will be bound by these Terms of Use and any changes that may be made to them from time to time.

1. KINGDOM OF WINTER LTD

2. USE OF THE SITE

2.1 You may not use the Site in any improper or unlawful manner or in breach of any legislation or licence that applies to you.

2.2 Except as expressly permitted, you agree that when using the Site you will not:

(a) publish, post, upload, store, distribute or disseminate any unlawful, defamatory, infringing, obscene, harmful, confidential, libellous, hateful, or otherwise illegal material or information or anything which might constitute a criminal or civil offence;

(b) upload files or other data that contain software or other material which are the intellectual property rights of any third party or which are protected by rights of privacy or publicity of any third party without having received all necessary consents; or

(c) upload files that contain viruses, corrupted files, or any other software or programs that may interfere with or damage the operation of the Site or any other computer.

2.3 You agree to comply with all reasonable instructions that we may give you from time to time regarding the use of the Site.

2.4 You are responsible for obtaining (at your own cost) all necessary equipment and telecommunications services required to access and use the Site. You are responsible for ensuring that no one uses your equipment to access the Site without your permission. We will be entitled to assume that anyone who accesses the Site using your equipment has your permission to do so and you will be liable for any Charges or any other costs, liabilities or damages that may be incurred by any such person.

3. COMPETITIONS AND PRIZE DRAWS

3.1 From time to time it may possible to enter competitions or prize draws through the Site. There may be additional terms and conditions applicable to those competitions or prize draws. Where additional terms apply you will be notified of that fact and given an opportunity to read those terms and conditions before you enter the competition or the prize draw.

4. INTELLECTUAL PROPERTY

4.1 All Intellectual Property Rights (as defined at 4.4 below) in or to the materials and information made available to you through the Site are either owned by us or licensed to us by our third party partners. You may only use such information or materials in accordance with these Terms of Use. Except as expressly provided in these Terms of Use, we do not grant any express or implied right to you to use the materials or information made available to you through the Site and nothing in these Terms of Use shall be construed as an assignment of any Intellectual Property Rights in or to such materials or information. All our rights are hereby expressly reserved.

4.2 You may view, download and print any materials and information made available to you through the Site subject to the following conditions:

(a) the material and information may only be used for your personal and non-commercial purposes;

(b) the material and information shall not be reproduced or included in any other work or publication in any medium without the written permission of KINGDOM OF WINTER LTD;

(c) the material and information may not be modified or altered in any way;

(d) the material and information may not be distributed or sold to any third party;

(e) you may not remove any copyright or other proprietary notices contained in the material or the information.

4.3 We do not give you any rights in relation to Intellectual Property Rights in any product or service that you purchase from or via the Site.

4.4 The term “Intellectual Property Rights” shall be taken to mean all patents, registered and unregistered trade marks and service marks, domain names, registered designs and design rights, copyright (including such rights in computer software and databases), database rights and moral rights (in each case for the full period thereof and extensions, revivals and renewals thereof), applications for the foregoing and the right to apply for any of the foregoing anywhere in the world, and all similar rights anywhere in the world including those subsisting in inventions, designs, drawings and computer programs.

5. WARRANTIES AND DISCLAIMERS

5.1 We will exercise all reasonable skill and care in providing the Site. We obtain the materials and information provided on the Site from third party partners and so we are not able to guarantee the accuracy, completeness, currency or reliability of any such materials or information.

5.2 Therefore, except as expressly provided in these Terms of Use, the Site and all materials and information provided through it are provided on an “as is” basis without warranty of any kind, either express or implied (whether by common law, custom, statute or otherwise) and all other conditions, statements and warranties (including, but not limited to, any implied warranty of the fitness for a particular purpose of the Site or that your use of the Site will not infringe the rights of any third party) are hereby excluded to the fullest amount permissible by law. Without limiting the foregoing, we make no warranty that the Site and all materials and information provided through it will meet your requirements. Therefore we advise you to check any materials or information provided to you through the Site as any reliance that you place on the accuracy, completeness, currency or reliability of that information is at your own risk.

5.3 This Site contains links to websites and microsites operated by third parties that are not under our control and are provided to you for your convenience only. We make no warranties or representations whatsoever about any other website which you may access through this Site or any services that they may provide. Without limiting the foregoing, these sites are in no way approved, vetted, checked or endorsed by us and you agree that we shall not be responsible or in any way liable for the content, accuracy, compliance with relevant laws or accessibility of any information, data, advice or statements or for the quality of any products or services available on such sites. If you choose to access a website beyond our control, you do so at your own risk. In addition, use of any such third party website or microsite may be subject to your acceptance of additional terms and conditions.

6. LIMITATION OF LIABILITY

6.1 Nothing in these Terms of Use shall be construed as an attempt to limit or exclude our liability in respect of:

(a) death or personal injury caused by our negligence;

(b) any loss suffered by you as a result of your reliance on any fraudulent misrepresentation made by us to you;

(c) any other liability that cannot be so limited or excluded at law.

6.2 Subject to Clause 6.1, you agree that we shall not be liable for:

(a) any indirect loss, claim or damage, or any punitive, special, incidental or consequential damages of any kind (including but not limited to lost savings or loss or corruption of data); or

(b) any loss of profit (whether direct or indirect), whether based in contract, tort (including negligence), strict liability, or otherwise, which arises out of or is in any way connected with:

(c) any use of this Site or its contents;

(d) any failure or delay in the use of any component of the Site or any service including, without limitation, any unavailability of the Site or the services irrespective of duration of any period of unavailability; or

(e) any use of or reliance upon any information, material, software, products, services and related graphics obtained through the Site,

in all cases even if we have been forewarned of the possibility of such loss or damage.

6.3 Without limiting the effect of Clause 6.2, due to the inherent risks of using the internet, we cannot be liable for any damage to, or viruses that may infect, your computer equipment or any other property when using or browsing the Site. The downloading or other acquisition of any materials or information through the Site is done at your own discretion and risk and with your agreement that you will be solely responsible for any damage to your computer system or loss of data that results from the downloading or acquisition of any such materials.

6.4 You agree that you shall indemnify us against any claims or legal proceedings that are brought or threatened against us by a third party because your use of the Site or any material or information through the Site is in breach of these Terms of Use.

6.5 Some goods or services may differ slightly from the description or appearance on the Site. Please check the delivered product/service immediately on receipt because we will not be held responsible for any subsequent loss or destruction.

6.6 We will notify you of any such claims or proceedings and keep you informed as to the progress of such claims or proceedings.

7. TERMINATION

7.1 We may terminate these Terms of Use immediately on giving notice in writing to you if:

(a) you commit any breach of any term of this Agreement; or

(b) you do not comply fully with Clause 2 above; or

(c) you commit a material breach of these Terms; or

(d) we choose to so terminate in our sole discretion.

7.2 You may terminate these Terms of Use forthwith subject to any outstanding payments due.

7.3 Forthwith upon termination of this Agreement, you cease all use of the Site. Any termination of this Agreement (howsoever occasioned) shall not affect any accrued rights or liabilities of either party nor shall it affect the coming into force or the continuance in force of any provision in this Agreement, which is expressly or by implication intended to come into or continued in force on or after such termination and neither shall it affect any common rights that are available to you.

8. DATA PROTECTION AND PRIVACY

8.1 We will only use any personal information that we may collect about you in accordance with our Privacy Policy.

9. NO WAIVER

9.1 Any failure or delay by us to enforce any of our rights under these Terms of Use is not to be taken as or deemed to be a waiver of that or any other right unless we acknowledge and agree to such a waiver in writing.

10. THIRD PARTY RIGHTS

10.1 These Terms of Use are not intended to be for the benefit of, and shall not be exercisable by, any person who is not a party to these Terms of Use under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

11. SEVERABILITY

11.1 If any clause or part of a clause of these Terms of Use is, or becomes, invalid, illegal or unenforceable, then that clause or part of a clause shall be deemed to be deleted from these Terms of Use. Any such deemed deletion shall not affect the validity, legality or enforceability of the remainder of these Terms of Use.

12. ENTIRE AGREEMENT

12.1 The warranties, exclusions and the other express provisions of these Terms of Use and the privacy policy set out the full extent of our obligations and liabilities concerning its subject matter and supersede any previous agreements between the parties relating thereto. Subject to Clause 6.1, you shall have no remedy in respect of any untrue statement made to you upon which you relied in entering into these Terms of Use other than any remedy you may have for breach of the express terms of these Terms of Use.

13. GOVERNING LAW & JURISDICTION

13.1 This Agreement is governed by the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the English Courts.

TERMS AND CONDITIONS (the “Terms”) FOR KINGDOM OF WINTER 2023/2024 (the “Event”)

1. GENERAL TERMS

1.1 The Event, held at Excel London, London (“Site”) is organised and managed by Kingdom of Winter Limited, a company incorporated in England and Wales with company number 14851741 and with registered office at 2 Grantley Close, Shalford, Guildford, England, GU4 8DL.

1.2 We set out below the Terms and Conditions (“Terms”) that shall apply to:
i) your entry to the Event;
ii) any purchase of Tickets to any Ticketed Attraction

1.3 The Terms relating to Tickets shall apply as set out below (may be varied by any Ticketing Terms and Conditions (if applicable, and as defined below)).

1.5 Furthermore, on entry to the Event you agree to accept and abide by any venue rules of Kingdom of Winter and  (“Excel London”) as stated here: www.excel.london/visitor/venue-guide/faqs (and any other regulations provided on entry to the Site).

1.6 Admission into the Event is at all times subject to these Terms and the terms, conditions and rules of the Excel London. If you breach any of these Terms and/or any such terms, conditions and/or rules then we may refuse admission or require you and/or other ticket holders to leave the Site.

1.7 We respect your Personal Data and shall deal with it in accordance with our Privacy Policy and applicable UK Data Protection legislation in place from time to time. Please see our Privacy Policy for further details.

1.8 We may seek to collect and process your personal data in response to a Pandemic, which is above and beyond what would ordinarily be collected from you, to ensure the safety and well-being of our officers, staff and the general public. Such information will be limited to what is proportionate and necessary, taking into account the latest guidance issued by the Government and health professionals, in order to manage and contain the virus. 2. GENERAL

2.1. You must comply with any and all instructions given to you by Kingdom of Winter Limited and/or all Event stewards and staff and with all Site regulations. Kingdom of Winter Limited reserves the right to restrict access to parts of the Site.

2.2 Use of all attractions (including any Ticketed Attraction) and rides is entirely at your own risk and Kingdom of Winter Limited will not be liable for any distress, inconvenience or anxiety caused during the course of any ride or attraction.

2.3 Valid identification may be requested as a condition of entry to certain venues and bars within the Event. Some venues and bars may use Identification Scanning software to carry out these checks.

2.4 Each visitor is responsible for his/her own personal property brought into the Site.

2.5 You agree that the Management will not be liable for any loss, injury or damage to any person (including yourself) or property however caused (including by Kingdom of Winter Limited or any Event staff): (a) in any circumstances where there is no breach of a legal duty of care owed by Kingdom of Winter Limited; (b) in circumstances where such loss or damage is not a reasonably foreseeable result of any such breach (save for death or personal injury resulting from Kingdom of Winter Limited’, its servants’ or agents’ negligence); or (c) to the extent that any increase in any loss or damage results from breach by you of any of the Terms.

2.6 Nothing in these Terms seeks to exclude Kingdom of Winter Limited or the Excel London’s liability for death or personal injury caused by our negligence, fraud or other type of liability which cannot be excluded or limited by law (including without limitation fraud or fraudulent misrepresentation).

2.7 To the fullest extent permissible in law, Kingdom of Winter Limited shall be entitled to assign all and any of its rights and obligations under the Terms, provided that your rights are not adversely affected.

2.8 If any provision of the Terms is found to be invalid or unenforceable by a court, the invalid or unenforceable provision shall be severed or amended in such a manner as to render the rest of the provision(s) and remainder of the Terms valid or enforceable.

2.9 If Kingdom of Winter Limited delays or fails to enforce any of the Terms it shall not mean that Kingdom of Winter Limited has waived its right to do so.

2.10 Any person, other than the Excel London, who is not a party to the Terms, shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the Terms.

2.11 Nothing in the Terms and no action taken by you or Kingdom of Winter Limited under the Terms shall create, or be deemed to create, a partnership, joint venture or establish a relationship of principal and agent or any other fiduciary relationship between you and Kingdom of Winter Limited.

2.12 You and Kingdom of Winter Limited both agree that it has not entered into the Terms in reliance of, and shall have no remedy in respect of, any statement, representation, covenant, warranty, undertaking or indemnity by any person other than as expressly set out in the Terms. Nothing in this clause shall operate to limit or exclude any liability for fraud.

2.13 The Terms do not and shall not affect your statutory rights as a consumer. For further information about your statutory rights contact Citizens Advice, Consumer Direct or the Department for Business Innovation and Skills.

2.14 For the purposes of the Terms, “Force Majeure” means any cause beyond Kingdom of Winter Limited’s control including, without limitation, act of God, war, insurrection, riot, civil disturbances, acts of terrorism, fire, explosion, flood, subsidence, lightning, earthquake or other natural disaster, weather of exceptional severity, epidemic, pandemic, disease, death or demise of a royal family member, royal mourning, national mourning, theft of essential equipment, malicious damage, strike, lock out, third party injunction, national defence requirements, acts or regulations of national or local governments. Kingdom of Winter Limited will not be liable to you for failure to perform any obligation under these or any other Terms to the extent that the failure is caused by Force Majeure.

2.15 Kingdom of Winter Limited reserves the right to change these Terms from time to time.

2.16 The Terms (including the Ticket Terms and Conditions) constitute the entire agreement between the parties in connection to the subject matter of the Terms and supersede any previous terms and conditions, agreement or arrangement between you and the Kingdom of Winter Limited relating to the subject matter of the Terms. However, nothing in the Terms shall purport to exclude liability for fraud or fraudulent misrepresentation. The Terms cannot be varied or amended in any respect (unless agreed between You and Kingdom of Winter Limited in writing).

2.17 These Terms shall be governed by English law and the parties agree to submit to the jurisdiction of the English courts in connection herewith. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in either the Northern Irish or the English courts.

3. ADMISSION AND EVENT TICKETS

3.1 A valid entry ticket (“Event Ticket”) entitles the holder to attend the Event on the date and at the times stated on the Event Ticket.  There shall be no admittance to the Event without a valid Event Ticket. You must retain your Entry Ticket on your person at all times during the Event.

3.2 All attendees of the Event agree to be bound by these Terms, those as detailed on any Ticket (as applicable), any Ticket Terms and Conditions (defined below as applicable), and such other terms as are drawn to the attention of visitors by Kingdom of Winter Limited.

3.3 It is the Event Ticket holder’s responsibility to check his or her Event Ticket(s), as mistakes cannot always be rectified and Kingdom of Winter Limited shall not be responsible for any incorrect Event Tickets.

3.4 Last entry to the Event is 20:00, there is no admittance after this time. You may only leave and then re-enter the Site during the Event at the discretion of Kingdom of Winter Limited or the Site. Otherwise, there shall be no re-admissions or pass-outs of any kind.

3.5 Event Tickets may not be used as prizes in competitions, “give-aways” or a lottery without the prior written consent of Kingdom of Winter Limited in its sole discretion.

3.6 Event Tickets must not be resold, exchanged, transferred, altered or defaced. Any such action shall render the Event Ticket(s) void (and any individual with such an Event Ticket may be refused entry or removed from the Event in Kingdom of Winter Limited’s sole discretion).

3.7 On entry to the Event all visitors agree to accept and abide by any Site rules of the Excel London (as may be updated from time to time) and any other regulations from time to time provided on entry to the Site.

3.8 Entry to Rides, Attractions and the Event is at the sole discretion of Kingdom of Winter Limited or the relevant operator. If Kingdom of Winter Limited or the relevant operator determine that access to the Event, Ride or Attraction should not be granted to a particular customer, such customer will not be entitled to a refund.

4. RIDES AND ATTRACTION TICKETS

4.1 All rides at the Event, require the payment by contactless to gain access (all rides at the Event, are each a “Ride” and together the “Rides”). The following attractions require a valid ticket to enter (list is subject to change): Ice Rink, Kingdom of Winter Circus, Expedition Ice (each a “Ticketed Attraction” and together the “Ticketed Attractions”).

4.2 You must produce a valid ticket to gain entry to all Ticketed Attractions within the Event (an “Attraction Ticket”) and you must produce that Attraction Ticket for inspection upon request at any time at the relevant Ride or Ticketed Attraction. Failure to produce an Attraction Ticket when requested in such circumstances may result in you being removed from the relevant Ticketed Attraction, Ride and/or the Event. Entry Tickets and Attraction Tickets must be used for the date they are purchased for. Attraction Tickets and Ride Tickets will be offered at no additional cost to personal assistants for access customers where possible.

4.3 Attraction Tickets are available for purchase online and onsite at the box offices.

4.4 A valid Attraction Ticket entitles the holder to attend the relevant Ticketed Attraction at the Event on the relevant date and at the relevant time(s) as stated on the Attraction Ticket. It is your responsibility to check your Attraction Ticket(s) and to ascertain the date and the time of your access to the relevant Ticketed Attraction.

4.5 No refunds or exchanges will be given for late arrival which results in customers not receiving a full session at the Ticketed Attraction(s) (as applicable). Late arrivals for all Ticketed Attractions will be allowed access at the discretion of the operator. We recommend you arrive at your specific Ticketed Attraction venue twenty minutes before your session time.

4.6 Certain attractions (including but not limited to the Ticketed Attractions) and Rides at the Event (including but not limited to the Rides) may be age and height restricted and other restrictions may apply to all Tickets and so it is the responsibility of the visitor to check before purchasing.

4.7 Onsite prices and Online prices for all ticket types may vary and are subject to change.

4.8 Children including those under 2 must have a valid Attraction Ticket to all Ticketed Attractions. Kingdom of Winter Limited reserves the right to determine the ratio of responsible persons in relation to children required for adequate supervision.

4.9 Ride Terms:
4.9.1 All Rides, attractions, amusements, transport systems and other facilities must be used in accordance with the operator’s instructions.

4.9.2 All rides at the Event require the payment before boarding the ride.

4.9.3 All rides close by 21:00 but note that some rides may close earlier.

4.10 Ticketed Attraction Terms:
i) Ice Skating
(a) Ice Skating can be hazardous. Participation in an Ice Skating session is entirely at your own risk. Neither Kingdom of Winter Limited nor the Excel London are responsible for any injuries arising from your use of the Ice Rink.
(b) Skaters must follow the instructions of the marshals at all times.
(c) The Ice Skating Manager reserves the right to remove those deemed a risk to the safety of others in their sole discretion.
(d) Items left in the Ice Skating Show Room are left at the owner’s risk.
(e) Children of 12 years or under must be accompanied on the ice and remain under the control or supervision of a person of 18 years or over at all times.
(f) The minimum age to be able to skate is 4 years old. All access to the rink is at the discretion of the Ice Rink management team.

(g) Skating aids are available on a first-come, first-served basis and cost £5.

(h) The minimum age to skate is 4 years old. Under 8’s must be accompanied by an adult; 1 adult to every 3 children. Between 8 and 12 year olds must be accompanied by an adult; 1 adult to 5 children.

ii) Ice Expedition
(a) Ice Expedition are continually kept in extremely cold conditions and attendees are advised to dress accordingly.

iii) Kingdom of Winter Circus
(a) All seats for these shows are allocated on a ‘first come, first served’ basis.
(b) Ticket holders arriving after the show has started may be asked to be admitted at a suitable time of the performance at the discretion of the operator.

(c) Pushchairs, prams and car seats are unable to be admitted to the Big Top, storage of such items in the designated area outside the tent will be done so at the owners risk.

5. TICKETS

5.1 Event Tickets and Attraction Tickets are together the “Tickets”.

5.2 Please read the ticketing agent’s conditions carefully which can be found at https://www.seetickets.com/content/terms-and-conditions (“Ticket Terms and Conditions”) prior to purchase and raise any queries with the ticketing agent or Kingdom of Winter Limited prior to purchase. Purchase or possession of a Ticket constitutes acceptance of the Ticket Terms and Conditions and these Terms.

5.3 All Tickets are sold subject to these Terms, the Ticket Terms and Conditions (for Tickets purchased online and at Event Box Offices) any other rules and regulations referred to herein or that may be applicable to the Event or Site at any time. It is your responsibility to check that you and your guests are permitted to attend the Event and have the appropriate Ticket(s). Do not buy Tickets or goods from unlawful sources. There is no guarantee of Ticket validity for entry validity for use unless purchased from the official ticket agents (either online or onsite) for the Event. Kingdom of Winter Limited reserves the right to refuse entry to the Event or any Ticketed Attraction or reject anyone from the same who is found with Tickets obtained in breach of either the Terms or the Ticket Terms and Conditions. Kingdom of Winter reserves the right to not accept and destroy any Tickets that are found to be in breach of the Terms.

5.4 Ticket sales are final. Unless otherwise stated herein (or in any Ticket Terms and Conditions), Tickets will not be cancelled, refunded or exchanged once you have purchased a Ticket other than as set out in these Terms. Any Ticket booking made via email, will be subject to these Terms. Once the booking is confirmed, any subsequent cancellation of the booking shall be subject to a 100% cancellation fee.

5.5 Without prejudice to the Refund Terms and any Ticket Terms and Conditions (if applicable), Tickets are non-transferable and must not be sold, offered for sale, made available, transferred or otherwise disposed of, save as set out herein, and we reserve the right to cancel without refund or compensation any such Tickets. Tickets are issued subject to Kingdom of Winter Limited’s right to alter or vary the Event due to events or circumstances beyond its reasonable control without being obliged to refund monies or exchange Tickets.

5.6 Any Tickets offered for sale, sold, transferred, used or disposed of in breach of clause 5.5, may be cancelled and any person(s) seeking to use the Ticket(s) may be refused admission to or be evicted from the relevant attraction, Ticketed Attraction, Ride and/or the Event.

5.7 Kingdom of Winter Limited are not responsible for any lost or stolen Tickets.

5.8 Tickets are issued subject to, and these Terms incorporate, the rules and regulations of the Excel London, and shall remain the property of Kingdom of Winter Limited who hereby reserves the right to recall any Ticket at any time.

5.9 Kingdom of Winter Limited reserves the rights to refuse admission to the Event to anyone who does not have a valid Event Ticket (including those which appear to be counterfeit or which have been altered and/or defaced).

5.10 Kingdom of Winter Limited are not liable for any Tickets that are lost or stolen, and to amend or deface any Ticket will render it void.

5.11 A child Ticket is for those 12 years and under. No child aged 12 or under (a “child”) will be admitted to the Event unless they are accompanied by a person aged 18 years or over (a “responsible person”) and such child or children whilst at the Event must remain accompanied and under the supervision of such responsible person at all timesThe responsible person shall have been given permission by the legal guardian of the child to be responsible for such child at the Event and in the event of an emergency. Kingdom of Winter Limited reserves the right to determine the ratio of responsible persons in relation to children required for adequate supervision.

5.12 Tickets may not be used for any advertising, competitions, contests, sweepstakes, promotions, or used, sold or given away in conjunction with other products or services (e.g. as part of a travel or hospitality package) without the express written permission of Kingdom of Winter Limited in advance. Failure to comply with the foregoing may result in the cancellation of the Ticket without any refund or compensation and/or the Ticket holder being refused entry or removed from the relevant attraction, Ticketed Attraction and/or the Event.

5.13 Tickets must be used on the date they are purchased for only. No refunds or exchanges will be given for any unused Tickets.

5.14 You must at all times comply with the Ticketed Attraction Terms for any use of the Ticketed Attraction(s) (as applicable) and the Rides Terms for any Rides.

6. TICKETS FROM THIRD PARTY AGENTS

6.1 Tickets purchased from an authorised ticket agent are bound by the Ticket Terms and Conditions (see link above) and neither Kingdom of Winter Limited nor The Excel London are responsible or liable for any mistakes to/ or losses for any such Tickets purchased through an authorised agent. Please refer directly to the ticket agent where you purchased your Tickets with any ticketing issues or enquiries.

6.2 Notwithstanding clause 6.1 above, these Terms shall apply in their entirety save as varied by any Ticket Terms and Conditions (including, without limitation, in relation to refunds and/or cancellation.)

6.3 Under no circumstances shall Kingdom of Winter Limited or Excel London are responsible or liable for any mistakes to/ or losses for any Tickets purchased through an authorised agent. Please refer directly to the ticket agent where you purchased your Tickets with any ticketing issues or enquiries, including in relation to any refunds/exchange.

6.4 Any Tickets bought from unauthorised agents or third parties are not valid and admission/use will not be permitted.

7. TICKET CANCELLATIONS AND REFUNDS

7.1 Your purchase of Tickets is subject to our right without prior notice and without refund or compensation to close or change the programme of rides and attractions (including Ticketed Attractions) and/or the Event’s operating hours.

7.2 Kingdom of Winter Limited in its absolute discretion reserves the right at any time to close all or any part of the Event, any attraction(s) (including any Ticketed Attraction(s), or to restrict the number of persons having access to the Event, any attraction(s) (including any Ticketed Attraction(s) due to capacity, or special events to ensure safety, security and/or order, or if Kingdom of Winter Limited reasonably considers the circumstances so require.  In either case, you may be entitled to a refund in accordance with clause 7.3, 7.4 and/or 7.5 below.

7.3 If the Event and/or any attractions (including any Ticketed Attraction or Rides) is/are cancelled/closed in its/their entirety for any reason, we will use our reasonable endeavours to notify Ticket holders as soon as possible (including notifying you of the details of any re-scheduled dates and operating hours the Event, Rides and/or attraction will be open). If you have already purchased a Ticket for the Event or a cancelled/closed Ticketed Attraction/Rides, you will automatically be entitled to a refund (save where any Ticketing Terms and Conditions preclude this.

7.4 If any Ticketed Attraction or Ride is curtailed during the session and you have a Ticket for that session, we may (but without obligation) offer a refund (in whole or in part) in our discretion (acting reasonably).

7.5 The Event will operate in line with any government rules/restrictions. The Operator reserves the right to cancel your Event Ticket(s) should governmental or other regulatory capacity restrictions and/or any decision of another relevant authority be implemented nearer the Event date. In the event of Event Ticket cancellations, the Organiser shall process refunds in accordance with all applicable Terms and Conditions relating to this Event

7.6 In all circumstances, where refunds are given by Kingdom of Winter Limited, the refund will be limited to a maximum of the face value of the ticket.

7.7 You are responsible for any travel and accommodation arrangements for the Event and except as set out in these Terms, Kingdom of Winter Limited shall not be liable for loss or damage of any kind whether direct or consequential, including but not limited to travel or accommodation expenses from postponement, cancellation, abandonment or curtailment of the Event and/or any attraction (including any Ticketed Attraction and/or any Rides) and the you hereby waive all rights of whatsoever nature against Kingdom of Winter Limited or the Excel London, their employees, servants, agents, independent contractors or representatives arising from cancellation, abandonment or curtailment of the Event and/or of any Ticketed Attraction/Rides.

8. EVENT SECURITY AND PROHIBITED ITEMS

8.1 The safety and comfort of all visitors is a priority. The Event has a robust security management plan, which is coordinated by Event security and the Metropolitan Police. If you see something suspicious, or something that does not feel right, please report it to a member of our security team.

8.2 To maximise safety, searches will take place at point of entry. Where operationally necessary, searches may take place on the Event site. This can include the use of metal detectors and searches of the person. All bags will be searched. Please note these searches are a condition of entry and attendance at the Event, any person with illegal or prohibited items or who does not want to be searched will be refused entry or evicted and their Ticket(s) will not be refunded. Please also note prohibited items listed below. We will not be able to look after these items for you or hold liability and you will not be able to enter the event or receive a refund. Security checks may result in delays when entering the Site, please leave extra time for these searches to take place.

8.3 We strongly advise not bringing large bags or luggage to the event as we may not be able to accommodate these. We advise only bringing a handbag or small rucksack. We ask all guests to be vigilant and not to leave bags and belongings unattended at any time. Any unattended item may be disposed of in line with our security protocols.

8.4 Please contact a steward immediately if you have any concerns or problems at the Event. It may not be possible to resolve unreported issues after the Event.

8.5 Prohibited Items. The following articles MUST NOT be brought into the Event: Knives, Work Tools, Fireworks (including sparklers), Smoke canisters, Air-horns, Spray Paint/Cans/large marker pens, Chinese/Sky Lanterns, Handheld Communication Devices (such as radios), High Visibility Clothing, powered or unpowered Skateboards, Scooters, or Bikes, Flares (such as emergency or distress flares manufactured for legitimate military, maritime, or transport purposes), offensive weapons/potential weapons/anything adapted for such purpose, Any object/ item considered to be potentially dangerous or harmful to public safety being a single item or a potential component part for another object, Laser devices, Bottles (unless empty, non-glass)/ glass vessels (including bottle/ cans- even if wrapped up as a present for a later time, Your own alcohol – even if wrapped up as a present for a later time, CS Gas Poles, Unmanned Aerial Vehicles (UACs) commonly known as “Drones” or “Remotely Piloted Aircraft”, Any article that might be used as a weapon and/or compromise public safety, Open bottles of drink/liquid (unopened and sealed bottles of water will be accepted, as will empty reusable cups and bottles), Illegal drugs, Nitrous Oxide (in any form), Drug Paraphernalia including Psychoactive Substances and Alkyl Nitrates (otherwise known as Poppers), Chairs/Stools, Banners/Flags, Sound Systems/items that can amplify sound, corrosive substances including acids and substances which are capable on application to the human body of causing hurt through corrosive action, unauthorised or counterfeit merchandise, kites, musical instruments, counterfeit or forged tickets and wristbands or an access pass of any description, unauthorised powered vehicles (motorbikes, quad bikes and buggies), any animals other than dogs (in accordance with clause 8.10). Unauthorised professional tape recorders, photography, and video equipment. Equipment considered to be professional will be permitted at the discretion of the security, any other items considered to be unsafe or potentially posing a risk to public safety and/ or security.

8.6 Any person in possession of any item set out at clause 8.5 (above) will be refused entry to the Event, removed from the Event, or will have such items confiscated and destroyed. Any article that might be used as a weapon, be deemed to be offensive or abusive, or compromise public safety, will be confiscated, and may be reported to the police.

8.7 In order to facilitate the security, safety and comfort of all patrons, Kingdom of Winter Limited and Excel London reserve the right in their reasonable discretion to conduct security searches of persons, clothing, bags and all other items on entry and exit to the Event and/or an attraction or ride, to confiscate items which may cause danger or disruption to the Event or other patrons or are in breach of these Terms and/or to refuse admission.

8.8 Use of illegal substances is strictly prohibited at the Event.

8.9 Visitors may be refused admission or ejected from the Event and the Site in accordance with Kingdom of Winter Limited’s Event eviction procedure if, in the opinion of Kingdom of Winter Limited and/or Excel London, the visitor is a risk to the safety of any patron and/or may affect the enjoyment of other patrons and/or the running of the Event or may cause damage, nuisance or injury. Examples include being (or appearing to be) drunk, incapable, intoxicated or under the influence of illegal drugs, under-age (where relevant), abusive, threatening, behaving anti-socially, carrying offensive weapons or illegal substances, committing a criminal offence, declining to be searched or are in breach of any of these Terms or the terms and conditions of the Excel London. Kingdom of Winter Limited reserves the right to refuse entry or evict all members of any group of persons where that group is behaving in accordance with the forgoing.

8.10 Dogs are not permitted at Kingdom of Winter. Dogs are not permitted into any rides or attractions, with exception of certified assistance dogs. No other animals are permitted on site.

8.11 Commercial, promotional and trading activities are not permitted at the Event without express prior written permission of Kingdom of Winter Limited. Please note that the Kingdom of Winter Limited will charge a fee for any commercial activity (including filming, photography and recording as per below) at the Event.

8.12 In the event of an emergency, visitors must follow instructions and directions from stewards, staff and other officials.

9. GOVERNMENT GUIDELINES

9.1 The event will follow all necessary Government guidelines that are applicable at the time of the Event.

9.2 Admission into the Event is at all times subject to these Terms and the terms, conditions and rules of the Excel London, and any rules and guidance issued by the UK government and the Local Authority. If you breach any of these Terms and/or any such terms, conditions and/or rules then we may refuse admission or require you and/or other ticket holders to leave the Site without refund.

9.3 Before arriving at the Site please ensure you are familiar with the latest rules and guidance issued by the UK government, including any rules regardingCOVID-19 (https://www.gov.uk/coronavirus), and you should not act contrary to such rules and guidance.

10. ALCOHOL

10.1 When purchasing alcohol at the Event, if you appear to be under the age of 25 you may be asked for valid identification that you are aged 18 or over.

10.2 Alcohol is not permitted to be taken into the Event and any alcoholic drinks purchased on site must be consumed before leaving. Bag searches will be in operation.

10.3 Kingdom of Winter Limited reserves the right refuse alcohol to any attendee who, in Kingdom of Winter Limited’s or any Event staff’s absolute discretion, is unreasonably intoxicated and/or is behaving in an unacceptable manner.

10.4 Climbing or standing upon tables, chair, benches, fences, barriers, trees, walls, safety fences, rock arrangements, ride structures, exhibits, buildings or anything similar is strictly prohibited.

10.5 The Event site will be operated in accordance with the Licencing Act 2003 and the Event Safety Plan.

11. FILMING AND PHOTOGRAPY

11.1 Please note that CCTV and film cameras may be present at the Event. By entering the Event and/or purchasing Tickets and attending the Event (including Ticketed Attractions/Rides), Ticket holders and attendees consent to being photographed, filmed and/or recorded, and consent to the image or recording of them (including any images or recordings taken by them within the Event) being used in distribution (commercial or otherwise) in perpetuity without any payment. All sound and moving or still picture rights including, without limitation, on the internet, vest exclusively with Kingdom of Winter Limited (or by any third party as may be engaged by Kingdom of Winter Limited).

11.2 Photography and filming on site is only allowed for the personal, non-profit making use of amateurs for appropriate reason and use only. Any inappropriate use may result in ejection in accordance with the Kingdom of Winter Limited’s Event eviction procedure. Commercial or editorial photography is prohibited without prior permission from Kingdom of Winter Limited. Accreditation must be requested from our press office in advance. Amateur photography groups must also request accreditation in advance of arriving on site.

11.3 A person may be denied entry to or removed from the Event if they found in possession of any equipment capable of taking photographs, making films, sound recordings or broadcasts; or if he or she takes any photograph, makes a film, sound recording or broadcast of anything occurring inside the Event for commercial gain (unless approved in accordance with clause 11.2). A person may enter the Event with the photography or filming equipment referred to in clauses 8.5 where it is integrated into electronic communications apparatus designed for personal private use (such as a mobile telephone) and/or a personal stills camera, but the person may still be removed in accordance with clause 8.6 above if they attempt to use this device for commercial gain. Removal of any customer in accordance with this term is at the sole discretion of Kingdom of Winter Limited.
